Our business law practice is preventive in nature. Lawyers can make a nice living when they help business clients do things the right way. Lawyers will make a lot more money when they are called in to clean up problems that a client has created without talking to a lawyer first. That's why preventive law makes sense for business.
We can help with items such as business formation and maintenance, contracts, leases, and a range of other matters.
If litigation becomes necessary, we have three decades of experience in litigating business disputes. In addition to the employment litigation areas mentioned below, we have experience with:
- Contract litigation.
- Unfair and deceptive trade practices.
- Trademark infringement and unfair competition.
- Fraud, including the NJ Consumer Fraud Act.
- Bankruptcy litigation.
- Real estate litigation.
- Estates and trusts litigation.
Employment law is a complex and growing area of the law. We represent both employers and employees, so we know the employment law business from both sides of the fence.
Employment litigation is a big part of our business. We don't do cookie-cutter law, churning out the same arguments for the same side case after case. We thrive on the diversity and creativity of problem-solving, and believe that knowing the law from both sides makes us better lawyers for all of our clients.
Some of the subject matter we deal with in the employment litigation area includes:
- Wrongful discharge
- Discrimination cases of all kinds, such as age, gender, disability, and race.
- Sexual harassment.
- Benefits law, including ERISA.
- Wage and hour claims, such as overtime.
- Family and Medical Leave Act.
- Retaliation.
- Whistle blower and public policy claims.
- Restrictive covenants, including non-compete agreements.
- Representation of individual defendants (usually accused of sexual harassment) when their employers won't defend them.
Our services in employment advice and counseling include:
- Hiring, discipline and termination.
- Payroll, record keeping and overtime issues.
- Independent contractor status.
- Employment contracts.
- Restrictive covenants, including non-compete and confidentiality agreements.
- Employee handbooks and other policies.
- Severance or separation agreements, for both management and employees.
- Leave issues, including FMLA and New Jersey Family Leave Act compliance.
- Accommodations in disability situations.
We have an active sports law practice and represent several NCAA Division I college athletic conferences. We are experienced in dealing with venue contracts for sporting events, sponsorship agreements, and media agreements with the major sports media companies. We recently successfully concluded an important Title IX case for one of our conference clients.
We have also represented coaches and smaller sports related businesses.
Frank Steinberg is an active and enthusiastic pilot. He holds an FAA commercial pilot certificate with instrument and multi-engine ratings. We have provided counseling and litigation services to airports in their dealings with host communities, including noise litigation.
We regularly represent pilots charged with violations of federal flight regulations by the FAA, and Frank Steinberg is an approved attorney of the Aircraft Owners and Pilots Association [AOPA] Legal Services Plan.
